TERMS OF SERVICE (Personal Commissions)

  • This is the official terms of service of Marc Angel Puzon (quilleart) as the artist, and you, the commissioner(s).

  • By commissioning the artist, the commissioner agrees that they have read and accepted all the terms described herein.

  • The terms are for personal artwork that will not be distributed or used in a commercial capacity.

  • Violators will be added to the artist's blacklist indefinitely and without warning.

  • If you are not willing to agree to my Terms Of Service, you may not request a commission.

  • My artwork is strictly forbidden to use for NFTs and usage in machine-learning (includes AI-Generation tech including but not limited to: Midjourney, DALL-E2, Stable Diffusion, and more).

I. PAYMENT

  • The artist tailors the commission to your budget, with the price bases as a minimum quality standard you, the commissioner, will get out of it.

  • The commissioner will get rough sketches before payment, afterwards there will be no refunds unless the artist does not meet the agreed deadline for delivery of Artwork.

  • Payment is in USD, full payment upfront unless asked to pay half of the agreed amount before delivery and half after.

  • The artist will send the commissioner a Paypal invoice once details are discussed and done with.

  • The artist is not responsible for any mistakes that are made on your part over the course of the transaction, and will not send any money over to "pay for fees" or similar actions.

  • The invoice must be paid within 1-2 weeks of issue, or the commission will be halted.

  • Once money is received, the artist will let the commissioner know when to expect work time around it, and update the commissioner if things change. Turnaround is usually within 1-3 weeks, but can take up to 2 months, depending on factors such as: Health, Order of Commission, Complexity, Work, or Personal Issues.

    • If any of the stated above occur the commissioner will be notified ASAP.

II. COPYRIGHT

The artist holds every right to the produced drawing, not the commissioner. Therefore the artist is allowed to use the copyrighted artwork to:

  • Display it in my portfolio, showcase along with my other works, and general promotional use.

  • Post it on their social media.

The commissioner(s) are allowed to:

  • Use the copyrighted artwork for personal use only unless agreed otherwise.

    • For small streamers (Below 300 average concurrent viewers) and other online content creators of a similar size, use of the artwork is allowed for social media content including streams, banners, and other online activities as long as the watermarked version is used.

    • A copyright fee shall be included if you wish the watermark removed.

  • Reserve the right to print or create an otherwise physical reproduction of the Artwork as long as it is for personal use only (ie. NOT for sale).

  • Use the art to promote themselves with proper credit given to the artist.

  • If the commissioner breaks copyright in any way, every right you had to the drawing will be retracted.

The following is considered copyright infringement:

  • Reproducing/tracing/using the copyrighted artwork commercially (profiting off the artwork in any direct way).

  • Taking credit for the creation of the artwork

  • Removing any watermarks/signatures.

  • Usage in cryptocurrency as NFTs or Non-Fungible Tokens or anything of that nature, material for usage in Artificial Intelligence or machine learning, usage in video editing or streaming without the artist's consent.

  • A Purchase of Commercial rights to the artwork will be discussed if the artwork is wanted for use commercially. Refer to this link for commercial commissions.

III. CANCELLING/REFUNDS

  • Canceling is only allowed before payment, and there are no refunds.

  • The commissioner gets sketches before payment, which the commissioner can only use after they commission the artist. This does not mean the commissioner is allowed to come to the artist for the express purpose of getting free sketches. Additionally, posting these sketches is prohibited, but the commissioner can use it as reference for another artist!

  • If the commissioner files a chargeback against the artist, they revoke their right to the current artwork the artist has made for them. The commissioner’s commercial rights will be retracted and the artist has the right to sell the copyrighted Artwork to new buyers.

  • The commissioner will also be blacklisted by the artist.
